After two-and-a-half hours of deliberation by the jury Friday, a Sidney man accused of rape, kidnapping and aggravated burglary was found not guilty on all three counts.
Robert L. Shoe, 30, 806 S. Main Ave., was charged in Shelby County Common Pleas Court with three first-degree felony counts stemming from an incident in March involving the mother of his two children.

According to court records, Shoe entered the Sidney residence of the alleged victim uninvited the afternoon of March 8. Authorities said Shoe sexually assaulted the 25-year-old woman several times before leaving the next morning.
According to the records, Shoe forced himself upon her, pulling her hair and confining her against her will. She told investigators that they have two children together.
The trial against Shoe lasted four days, with the jury reaching the not guilty verdict Friday afternoon after commencing deliberations at approximately 2 p.m.
Shoe spent most of Friday morning on the stand. The defense and prosecution then gave their closing arguments beginning at approximately 12:45 p.m. Friday.
Most of Thursday was taken up by Shoe's defense, attorneys Chris Bucio and Jeremy Tomb from Troy, calling witnesses.

The state spent Tuesday afternoon and Wednesday presenting its case by calling several witnesses to the stand including the alleged victim, a sexual assault nurse examiner from Wilson Memorial Hospital, a DNA expert from the Miami Valley Crime lab, the police officer who took the initial report and the lead detective in the case. The state, which was represented by Shelby County Prosecuting Attorney Ralph A. Bauer, rested its case Wednesday afternoon.
