Notice of Commencement


Do you need the advice of a construction litigation attorney? A notice of commencement is a document that is provided prior to the initiation of a commercial or residential property development. The Ohio code states the necessary guidelines to comply with the mandates that are prescribed by Ohio statutes governing real property liens. 

The function of the document is to provide notice to those that are involved with the property development. Some of the details that are provided in the notice of commencement are:

  • The name and description of the real property where the improvements are to take place.
  • A general description of the improvement to be performed.
  • The name, address and date that the general contractor first initiated the contract.
  • The name, address and contact information for all lenders that are providing financing for the improvement.
  • A physical statement of the commencement to lien claimants.
  • The name, address and contact information for the notice preparer.
  • An affidavit from the owner that verifies the notice.
The purpose of the notice of commencement is to provide information to those that are involved in a residential or commercial real property improvement, the required information to contact the fee owner of the property regarding liens to the property.

The property owner must file the notice of commencement with the county office where the real property development is located, deliver a copy of the notice to the contractors, and post the notice at the physical location of the improvement site, and provide a copy of the notice to any possible lien claimant that requests a copy of the notice.
